In-app purchases and subscriptions: in the app “Love Your Life”, the membership is purchased exclusively via the store from which the app was obtained, i.e. via the Apple App Store or via Google Play. Price, payment, automatic renewal, termination, withdrawal and refund are governed in this respect by the terms of the store and the rules of the General Terms and Conditions on membership in the phone apps. All other services are also billed in the apps via the platform's payment channels; the terms for voice credit apply to voice credit.
Apple App Store: this Agreement is concluded only between the User and BGGI, not with Apple Inc. (“Apple”). BGGI, not Apple, is solely responsible for the Software and its content.
Apple has no obligation whatsoever to furnish any maintenance or support services with respect to the Software.
In the event of any failure of the Software to conform to any applicable warranty, the User may notify Apple, and Apple will refund any purchase price of the Software. To the maximum extent permitted by law, Apple has no other warranty obligation whatsoever with respect to the Software. BGGI is responsible for any other claims, losses, liabilities, damages and costs attributable to any failure to conform to any warranty, insofar as they are not excluded under this Agreement.
BGGI, not Apple, is responsible for addressing any claims of the User or any third party relating to the Software or the User's possession and use of the Software, in particular product liability claims, claims that the Software fails to conform to any applicable legal or regulatory requirement, and claims arising under consumer protection and data protection law. In the event of any third-party claim that the Software or the User's possession and use of the Software infringes that third party's intellectual property rights, BGGI, not Apple, is responsible for the investigation, defence, settlement and discharge. The extent of the Provider's liability towards the User is governed by § 10.
The User warrants that they are not located in a country that is subject to a United States Government embargo or that has been designated by the United States Government as a terrorist-supporting country, and that they are not listed on any United States Government list of prohibited or restricted parties.
When using the Software, the User complies with applicable third-party terms, such as those of their mobile network operator. Apple and Apple's subsidiaries are third-party beneficiaries of this Agreement; upon acceptance of this Agreement, Apple will have the right to enforce it against the User as a third-party beneficiary.
Google Play: if obtained via Google Play, the Google Play Terms of Service apply additionally. Google is not a party to this Agreement.
“Love Your Life Verwaltung”: this app is not offered publicly and may only be used by persons for whom BGGI has set up an administration account. For employees, the agreement for employees on confidentiality and system use applies additionally. Passing the app on to other persons is prohibited.
Third-party components: the Software may contain third-party components, including open-source components. The licence terms of these components apply to them with priority; BGGI makes the licence notices available on request.
Usage limits: technical limits described on the platform apply to individual functions, for example a maximum of 20 pages per operation and 8 MB per page for the document scanner, as well as limits on the number of requests to protect against misuse.
No emergency service: the Software does not replace the local emergency medical service and does not make a diagnosis. In life-threatening emergencies, contact the emergency number of your country without delay, in Germany and in the European Union 112.
Purchases outside the stores: you cannot book additional storage space and other subscriptions that BGGI offers on its website in the apps. If your storage space reaches a notification threshold, the apps show only the notice, without a price, link or purchase option.
