Withdrawal notice

You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day the contract was concluded.

To exercise the right of withdrawal, you must inform us (BGGI GmbH, Rostocker Straße 43, 53117 Bonn, Germany, email: kontakt@bggi.de) of your decision to withdraw from this contract by an unequivocal statement (e.g. a letter sent by post or an email). You may use the attached model withdrawal form, but it is not obligatory.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

If you withdraw from this contract, we shall reimburse to you all payments received from you without undue delay and in any event not later than fourteen days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction; in any event, you will not incur any fees as a result of such reimbursement.

If you requested that the service begin during the withdrawal period, you shall pay us an amount which is in proportion to the services already provided until you have communicated to us your withdrawal from this contract, in comparison with the full coverage of the contract.

For a service contract, the right of withdrawal expires early if we have fully performed the service and only began performance after you gave your express consent and simultaneously confirmed your awareness that you lose your right of withdrawal upon full performance of the contract by us (§ 356(4) German Civil Code).

When you book services to be performed immediately (e.g. a short-notice video consultation, an urgent second opinion), we obtain this express consent and confirmation of awareness before performance begins.

The membership is a contract for the recurring provision of services. The right of withdrawal of fourteen days from conclusion of the contract described above applies to it as well.

If you expressly request that the membership begin during the withdrawal period and you subsequently withdraw, you owe proportionate compensation for the services provided up to the withdrawal.

Independently of the right of withdrawal, you can cancel the membership at any time via the portal (§ 15 of the general terms and conditions). A cancellation is not a withdrawal: it takes effect at the end of the month already paid for and leaves invoices already issued unaffected.

For orders of medicines through the platform the right of withdrawal applies with the following restriction: in the case of sealed goods which are not suitable for return for reasons of health protection or hygiene, the right of withdrawal expires if the seal has been removed after delivery (§ 312g(2) no. 3 of the German Civil Code).

As long as an order has not yet been dispatched, you can cancel it via the portal; amounts already paid are returned under the rules on credits and refunds (§ 20 of the general terms and conditions).

Whether and to what extent medicines can be taken back beyond this is governed by pharmaceutical law and by the terms of the dispensing pharmacy. The platform does not provide a return function.

If you take out the membership in one of our phone apps, the purchase is concluded through the Apple App Store or Google Play respectively. Withdrawal, refunds and cancellation are then governed by the terms of the respective store; please address any such request directly to the store.

A subscription concluded in the store can be neither cancelled nor refunded through the BGGI portal. Cancellation, changing the tier and refunds are handled in the subscription management of your device. Your statutory rights against the store remain unaffected.

For all other services booked through the platform this withdrawal notice applies unchanged — even if you book them in a phone app.
