Cooperation Agreement for Doctors
Last updated: 23 October 2026
This is a translation for convenience. In case of discrepancies, the German version shall prevail.
§ 1 Contracting parties
This Cooperation Agreement is concluded between BGGI GmbH, Rostocker Straße 43, 53117 Bonn, register court Amtsgericht Bonn, HRB 26753 (“BGGI”), operator of the “Love Your Life” platform, a brand of BGGI GmbH, and the doctor who accepts it digitally via the platform (the “Doctor”). The term “Doctor” applies to all genders.
“Platform” within the meaning of this Agreement is the “Love Your Life” platform with its portals and applications. “Patients supported via the Platform” are patients who have come to the Doctor via the Platform.
§ 2 Subject matter of the agreement and status of the Doctor
The subject matter of this Agreement is cooperation in the organisation, coordination and processing of medical and aesthetic treatments for patients who are supported via the Platform.
The Platform keeps separate fields of treatment, in particular medicine and beauty. This Agreement applies to each field in which the Doctor is listed and approved on the Platform; § 13 additionally applies to the field of beauty.
The Doctor works as a self-employed professional under their own responsibility. No employment, partnership or commercial agent relationship is established.
Medical treatment is provided exclusively under the Doctor's responsibility; the treatment contract is concluded directly between the Doctor and the patient. The medical service is owed and answered for solely by the Doctor in their own name. BGGI provides no medical treatment and no medical advice, but exclusively organisation and support services (§§ 3 and 20).
If the Doctor is assigned to a hospital or clinic on the Platform, they receive cases via that hospital only after the hospital has confirmed their affiliation. If a case is handled via the office of a hospital, the Doctor sees the documents only once the office has released them.
§ 3 Services of BGGI
BGGI performs the following organisation and support services for the Doctor: making available the Platform and the doctor section, preparing and forwarding cases, coordinating appointments and video consultations, organising accompanying services such as interpreting, transfer and appointment organisation, communicating with patients via the Platform, processing the services booked via the Platform including invoicing, collection and payout and — where booked — translation support. BGGI names a contact person for the Doctor.
Accompanying services such as interpreting or transfer are performed by the service providers engaged in each case; BGGI organises them.
BGGI does not owe any particular number of cases, enquiries or revenue and does not answer for patients attending appointments or providing correct and complete information.
§ 4 Creation by BGGI and takeover of the profile
BGGI may create a profile of the Doctor on the Platform before the Doctor has registered themselves. Only the information required for the invitation and the subsequent check is recorded, in particular name, country, specialties and areas of focus, languages and professional contact details.
The Doctor receives an invitation by e-mail in their language, otherwise in English. The link in the invitation is time-limited; BGGI may renew or withdraw the invitation. With the invitation, BGGI informs the Doctor about the creation of the profile and the information processed in the process.
By setting their password, the Doctor takes over the created profile. They check, correct and complete the information recorded by BGGI; from the takeover onwards, they are responsible for the accuracy of their information.
Consents, declarations and the acceptance of this Agreement are given only by the Doctor themselves, never by BGGI in their name. Until the profile has been taken over and approved under § 5, the profile does not appear in any list, is not publicly visible and receives no cases.
If the Doctor does not accept the invitation or objects to the creation of their profile, BGGI deletes the created profile, unless a statutory retention obligation precludes this.
§ 5 Professional authorisation, doctor's registration number and professional liability insurance
The Doctor provides proof of their licence to practise medicine or professional authorisation and their doctor's registration number. BGGI checks the information before approving access and may request the proof again at any time.
If the professional authorisation lapses, is suspended or is restricted, the Doctor notifies BGGI of this without undue delay. Until the matter has been clarified, the allocation of new cases is suspended.
During the term of this Agreement, the Doctor maintains professional liability insurance that covers, in an appropriate amount, the medical services organised via the Platform — including video consultations and the treatment of patients resident abroad. § 5a applies to the proof, the reminder and the consequences of missing insurance cover.
§ 5a Professional liability insurance
The contractual partner within the meaning of this section is the other party to this contract. The contractual partner is obliged, for the entire term of this contract, to maintain professional liability insurance that covers personal injury, property damage and financial loss arising from its activity under this contract in an amount sufficient for the type and scope of this activity, including towards patients resident abroad. Business liability insurance that covers this damage also counts as professional liability insurance within the meaning of this section. Further insurance obligations under this contract or under the law remain unaffected.
The contractual partner deposits in its area of the platform proof of the insurance stating the insurer and the date until which the cover exists (expiry date), and keeps it up to date. If the insurance cover ends, is suspended or is reduced, it notifies BGGI of this without undue delay via the platform.
Missing, expired or not yet reviewed proof does not lead to a block of access, to the refusal or withdrawal of approval or to the contractual partner receiving no requests, cases, orders or assignments. The same applies if the insurance cover ends, is suspended or is reduced. The obligation under paragraph 1 remains unaffected.
If the contractual partner does not maintain insurance under paragraph 1 or if its scope is insufficient, it is liable alone and itself for damage arising from its activity; it bears the risk of missing or insufficient insurance cover. BGGI is not an insurer, does not provide insurance cover and is not liable for the absence or inadequacy of the contractual partner's insurance. Whether or not BGGI has reviewed proof does not change this.
If a patient or another third party makes a claim against BGGI for damage arising from the activity of the contractual partner that would have been covered by insurance under paragraph 1, the contractual partner indemnifies BGGI against this claim and against the reasonable costs of legal defence, insofar as BGGI is not responsible for the damage. BGGI informs the contractual partner without undue delay of the claim and does not acknowledge the claim without its consent. Statutory claims of patients and other injured parties against BGGI or against the contractual partner remain unaffected; this paragraph governs solely the relationship between BGGI and the contractual partner.
If the contractual partner has not deposited valid proof, the platform reminds it of this once three months and once one year after the approval of its access. No further reminders regarding the proof are sent, not even if the contractual partner closes a reminder without depositing proof.
§ 6 Obligations of the parties
The Doctor warrants: a valid licence to practise medicine or professional authorisation, adequate professional liability insurance, compliance with medical professional law and confidentiality, truthful profile information and price quotations and the careful and timely processing of the cases allocated via the Platform. After an appointment, the Doctor enters the result on the Platform in a timely manner.
BGGI makes the services under § 3 available to the Doctor, shows them at all times in the doctor section the status of their cases, appointments and amounts and allocates cases to them only in the fields and specialties for which they are approved. A case is transmitted to the Doctor only once the payment due for it from the patient has been received and BGGI has released the case; each transmission is recorded in the case history with the time and the acting person.
Both parties inform each other without undue delay of circumstances that jeopardise the performance of this Agreement, in particular of errors in the preparation of a case, in an invoice or in a payout.
The Doctor submits a report or course report for the patient via the Platform. The patient receives it only once BGGI has released it; until then it lies in the case file as “awaiting release”. The release is organisational; BGGI does not review the content medically and may return the report to the Doctor, stating a reason. A report may not contain any contact details; the Platform rejects a report containing contact details. Submission, release and return are recorded in the case history with the time and the acting person.
The Doctor issues prescriptions via the Platform under their own medical responsibility; whether they issue a prescription is decided solely by them. If a pharmacy requests a prescription for a patient from the Doctor via the Platform, the Doctor receives the request in their area; there is no entitlement to the prescription. A prescription that the Doctor issues via their own account is deemed to have been confirmed by them. It may form the basis for a delivery by a pharmacy to the country to which the patient has returned home if the patient attended an on-site appointment with the Doctor in Germany via the Platform; the Doctor prescribes only what they are permitted to prescribe under the law applicable to them.
Planning in the calendar: the Doctor sets in his calendar whether the planning assistant Laura only prepares forwarded appointment requests as a proposal (“Manual”, default) or enters them herself in suitable free times of his colour blocks (“Automatic”); an appointment entered in this way is deemed to have been set by him. If he sets an appointment within the time window that the patient has stated, it is agreed; outside it, the patient must confirm the time. Leave that he enters blocks the time for new appointments.
§ 7 Support via the Platform
For patients supported via the Platform, all services initiated via the Platform — consultation, second opinion, video consultation, treatment organisation and booked service offerings — are processed and invoiced via the Platform.
BGGI asks the Doctor to continue to serve patients supported via the Platform through the Platform; this Agreement does not establish any obligation to do so. The case thus remains fully documented, and the arrangements on services and costs remain binding. The request relates to the same treatment episode during the term of this Agreement and for twelve months after the last contact established via the Platform.
The patient's free choice of doctor, the Doctor's statutory and professional obligations, in particular treatment in emergencies, and treatment relationships that demonstrably existed or arose independently of the Platform remain unaffected.
Services agreed and performed via the Platform are invoiced via the Platform; the amounts agreed for them remain owed even if support is subsequently continued outside the Platform. In order to invoice these services, BGGI may request information about the services performed, insofar as this is necessary and permissible under data protection law. The Doctor owes BGGI no fee for treatment that they provide outside the Platform or for a patient having come to them via the Platform.
No contractual penalty is agreed with the Doctor. Further statutory claims, in particular for damages, remain unaffected.
§ 8 Brief feedback on the presentation of a case
When a patient submits a case, they may choose as the first service to have the case first presented to a doctor in the region (“Presentation”). BGGI then presents the case to the Doctor with the documents submitted.
The Doctor responds with brief feedback on whether or not they accept the case and may add a brief assessment. The feedback is not a medical report and not a cost assessment; it is based solely on the documents presented.
The Presentation is an organisational service that BGGI performs for the patient and charges for itself: BGGI prepares the case, presents it and transmits the feedback. The Doctor alone is responsible for the content of the feedback; BGGI does not adopt it as its own. The Doctor receives no fee for the feedback; no claim to remuneration, reimbursement of expenses or payout arises from the Presentation.
The Doctor is not obliged to accept a case presented. If the Doctor accepts it, all further services booked via the Platform are governed by § 15. If the Doctor declines or does not respond within the period shown on the Platform, BGGI may present the case to another doctor.
The feedback appears in the patient's portal as soon as BGGI has released it; the release is organisational, BGGI does not review the content medically and may return the feedback to the Doctor, stating a reason. It may not contain any contact details; the Platform rejects feedback containing contact details. The length of the assessment is limited.
Medical due care and the professional law limits on remote treatment apply to the feedback. If a statement cannot be justified without a personal examination, the Doctor points this out in the feedback.
§ 9 AI-supported case preparation
BGGI prepares cases with the support of artificial intelligence — for example through summaries of the documents, translations and indications of possible specialties — and forwards this preparation to the Doctor.
The preparation is a working aid. It is not a diagnosis, not a treatment proposal and not a finding and does not replace the Doctor's own review. The Doctor reviews the documents personally and decides under their own responsibility.
The Doctor reports apparent errors in the preparation to BGGI so that they can be corrected.
BGGI gives no guarantee for the accuracy and completeness of the preparation; it is an aid and not a medical service of BGGI. BGGI's liability under § 20 paragraph 6 remains unaffected.
If earlier cases of the patient are linked to the current case — by the patient themselves or by BGGI —, the Doctor receives their documents and a summary of the course only if BGGI has released them for disclosure, the case has been paid and is not suspended and the patient's consent is valid. Every retrieval is logged.
§ 10 Video consultation, transcript and summary
Video consultations are held via the Platform. Access to the video room exists only within the time slot of the appointment.
Before each video consultation, the Platform asks the patient and the Doctor whether the conversation may be transcribed for an AI summary. Each side answers yes or no. If the patient has booked the AI interpreter, they are asked this question in the same step as the consent to the AI interpreter (§ 11). The answers are recorded with the person and time; the Doctor sees the patient's status.
Each side may change its answer until the start of the appointment; thereafter it can no longer be changed. The Doctor may also join the conversation without giving an answer. As long as both sides have not answered yes, no transcription takes place.
Only if both sides have answered yes does the Platform transcribe the conversation. Audio is never stored in the process: the contributions of the patient and the Doctor are captured via their microphones and immediately converted into text by speech recognition; only this text is stored, in encrypted form (the “transcript”). If the AI interpreter is in use, the transcript consists of the utterances it has rendered, in the original and in translation.
After the conversation, an artificial intelligence creates from the transcript a summary for the patient and one for the Doctor, each in their own language. This applies equally without an interpreter, with the AI interpreter and with a personal interpreter. If one side has not answered yes or has replaced its yes with a no, no summary is created and any existing transcript is deleted; the video consultation takes place nonetheless.
The transcript is deleted as soon as both summaries have been created, likewise after the last unsuccessful attempt to create them, and in any case no later than seven days after it was created.
The summaries appear in the Doctor's portal and in the patient's portal in the respective case and remain there like case documents. They are labelled as AI summaries, are intended to reflect only what was said and may contain errors or omissions. A summary is not medical documentation and not a medical report; the Doctor's duty of documentation remains unaffected. The Doctor checks content before relying on it. BGGI gives no guarantee for the completeness and accuracy of the summaries; § 20 paragraph 6 remains unaffected.
The summary is included in the price of the appointment; neither the patient nor the Doctor incurs additional costs for it. If the Doctor answers no, the appointment and fee remain unaffected.
§ 11 AI interpreter
If the Doctor and the patient do not speak the same language, an AI interpreter may be used in the video conversation. It renders the spoken word section by section in both directions, outputs the translation as speech and displays the original and translation as subtitles. If no voice is available for a language, currently Kurdish, the translation into that language appears only as subtitles.
The AI interpreter is used only if the patient has consented; separate consent of the Doctor to the AI interpreter is not obtained. Before the start, the Doctor sees whether the patient has consented or refused. The AI interpreter may also be added alongside a personal interpreter.
Machine interpreting is an aid to communication; it is not certified and may contain errors. In the case of medically significant statements — in particular information, consent and medication — the Doctor makes sure that they have been correctly understood and have correctly understood, asks questions in case of doubt and, if necessary, calls in a personal interpreter. Responsibility for informing the patient medically remains with the Doctor. BGGI gives no guarantee for the accuracy and completeness of machine interpreting; § 20 paragraph 6 remains unaffected.
If the renderings of the AI interpreter and of a personal interpreter differ, the Doctor clarifies the statement by asking before relying on it.
BGGI charges the patient for the costs of the AI interpreter in accordance with the General Terms and Conditions; the Doctor's fee is not affected by this.
On-site interpreting: in his area, the Doctor may send a patient, including a person without an account on the platform, a link by e-mail with which that person books and pays for one hour of interpreting by the AI interpreter Lina for a conversation on site. For this, he enters only the e-mail address and the languages, and only if the person agrees; the e-mail contains no health information and not the Doctor's name. After payment, the session can be opened on the Doctor's device or on the person's device; Lina speaks only as a voice, and nothing is recorded. Paragraph 3 applies accordingly. The costs are borne by the person; the Doctor's fee is not affected by this, and the Doctor receives nothing from the booking.
§ 12 Diagnostic and service units
The Doctor may register in their section of the Platform external diagnostic and service units with which they cooperate, in particular laboratories, X-ray, MRI and CT, nuclear medicine, pathology, physiotherapy, dental laboratories and medical supply stores (“Unit”). Upon entry, the Unit receives an invitation to register on the Platform. The Doctor enters only professional contact details of the Unit.
For a case of their own that they have accepted, the Doctor may engage a Unit to perform a service (“Order”). The patient receives a notification of this and pays the total amount in the portal. The Unit uploads values, findings and images to the Platform; they appear to the Doctor and in the patient's case.
The Doctor engages a Unit only if there is a medical or objective reason for doing so and informs the patient that they may also obtain the service from another unit of their own choosing.
For registering a Unit, for an Order and for any service of a Unit, the Doctor receives neither from BGGI nor from the Unit a fee or any other benefit. The Doctor does not demand any such benefit, does not accept a promise of one and does not accept one. A surcharge of ten percent is added to the Unit's price, which is due in full to BGGI; it is the fee solely for BGGI's services to the Unit and the patient, and neither the Doctor nor an agency has any share in it. The platform surcharge and agency surcharge are not levied on Orders to Units.
§ 13 Field of beauty
Cases in the field of beauty are allocated to the Doctor only insofar as they are listed and approved on the Platform for specialties in that field. The Doctor provides proof of the specialist or additional qualification that the law of the country in which they practise requires for the aesthetic procedures offered.
Aesthetic procedures without medical necessity require particularly thorough information. The Doctor provides information about risks, prospects of success and limits of the result, recovery time, possible follow-up procedures and alternatives including forgoing the procedure and allows an appropriate time for reflection before the procedure; as a rule, the information is not given only on the day of the procedure.
Aesthetic procedures without medical necessity on minors are not organised via the Platform.
The Doctor does not advertise via the Platform with comparative depictions of the physical condition or appearance before and after a surgical cosmetic procedure without medical necessity and complies with the other requirements of the law on advertising in the healthcare sector. This also applies to images and texts in their profile (§ 14).
Some procedures may be medically necessary or aesthetic, for example a nose correction after an accident or a reconstruction after cancer. BGGI may therefore move a case to the respective other field; documents and history are retained, and the reason, person and time are recorded. If the Doctor considers the allocation of a case to be incorrect, they inform BGGI of this via the Platform.
The Cooperation Agreement for Beauty Centres and Facilities in the Field of Beauty applies to institutions in the field of beauty; the Special Terms for the Field of Beauty additionally apply to patients.
§ 14 Images and profile information
The Doctor may upload images to their profile, in particular a portrait and images of practice and treatment rooms. Authorised BGGI staff may also upload, arrange and remove images for the profile.
Each new image is checked and approved by BGGI before publication, even if BGGI uploaded it itself. When saving, the Platform removes embedded metadata such as the location of the shot and device data. Reduced-size versions are displayed publicly, not the original file.
The Doctor warrants that they hold the necessary rights to the images and texts they provide and that recognisably depicted persons have consented to publication. The Doctor does not upload images of patients or comparative depictions before and after a treatment.
For the term of this Agreement, the Doctor grants BGGI a simple, free-of-charge, territorially unrestricted right in the images and profile texts provided to reproduce them, make them publicly available and edit them to the extent technically necessary, in particular to crop them, reduce their size and remove metadata, for the purpose of presenting the Doctor on the Platform, in the Love Your Life applications and on the public partner map. Any use outside the Platform, for example in advertising or social media, requires the separate consent of the Doctor.
If the Doctor removes a current image, it is no longer displayed and its files are deleted. BGGI retains older versions replaced by a newer image as a history; the privacy policy states the duration of this retention. Upon termination of this Agreement, the right of use ends and BGGI removes the images from the presentation.
BGGI may reject or remove from the presentation images and texts that infringe the rights of third parties, the law on advertising in the healthcare sector or this Agreement.
By way of derogation from paragraph 4 sentence 2, BGGI may also publish images and videos that the Doctor has uploaded and BGGI has approved on Love Your Life's own social media channels, in order to present the platform and the Doctor's services. For this purpose, BGGI may edit them, in particular crop, shorten and subtitle them and translate texts and subtitles, without distorting their message; for this purpose, the Doctor grants BGGI, for the term of this Agreement, a simple, free-of-charge, territorially unrestricted right of use. By uploading them, the Doctor confirms that recognisably depicted persons have also consented to this publication, and provides evidence of the consents on request. BGGI publishes images and videos showing a patient only if that patient's express written consent to this publication has been given; paragraph 3 sentence 2 remains unaffected. Every post complies with the law on advertising in the healthcare sector; BGGI does not publish comparative depictions before and after a treatment or procedure. After the end of this Agreement, BGGI no longer publishes any new posts and removes posts already published at the Doctor's request.
§ 15 Remuneration and due date
The Doctor sets their own fees for consultation, conversation and video services on the Platform. Neither a minimum nor a maximum amount is prescribed; if an amount exceeds the stored reference value, it is saved and the Platform merely points this out. The fee is the remuneration solely for the Doctor's own medical service.
The basis for payout is the Doctor's services booked via the Platform and paid for by the patient; payout is made only once the payment has been received by BGGI. Invoicing, due date and payout are governed by the agreed payment model (§ 16).
Open, released, paid-out and cancelled amounts as well as third-party costs and fees can be viewed in the doctor section at any time. The same amount is never paid out twice; there is no minimum amount for payout.
Payment is made cashless, at the Doctor's choice in the doctor section, by bank transfer to the bank details stored there or to the Doctor's own account with the payment service provider Stripe, insofar as Stripe offers this account in the Doctor's country. The Doctor sets up the Stripe account on Stripe's site and manages it there; Stripe pays out from this account to the Doctor's bank. Each payout is released under the four-eyes principle on both routes: whoever prepares it does not release it themselves. The Doctor notifies changes of bank details via the doctor section; they are checked separately before the next payout is made. The Doctor may change the payout route in the doctor section at any time; BGGI is informed of every change.
Amounts are owed and invoiced in euros. The Doctor may choose payout in US dollars in the doctor section. The amount is then converted at the reference rate of the European Central Bank used by the Platform; a currency exchange deduction is deducted, the rate of which is shown in the doctor section before the choice is made. The rate and deduction are fixed when the payout is released; the Doctor bears the exchange rate loss. The choice of payout in US dollars applies to the bank transfer; amounts are transferred to the Stripe account in euros, and the currency in which Stripe pays out from there depends on the settings of that account.
Surcharges that BGGI charges the patient — the platform surcharge as the fee for BGGI's services (support, translation, interpreting services, visa and travel organisation, case support, administration and use of the Platform) and, if an agency supports the patient, the agency surcharge as the fee for the support services of that agency, for the proven support of the treating hospital by an agency engaged by BGGI for this purpose and for their administration and invoicing by BGGI — are charged in addition to the fee. They do not reduce the Doctor's fee, and the Doctor pays neither BGGI nor an agency any remuneration for patients being channelled to them. The platform surcharge and the agency surcharge are calculated side by side on the pure fee amount, not on top of each other; neither surcharge is the basis of the other.
§ 15a Direct payment on site
For a service that the Doctor has performed on site for a patient of the Platform and that has not been booked or invoiced via the Platform, the Doctor may enter an amount and a reason in their section of the Platform (“Direct Payment on Site”). The reason always describes the service performed; no amount may be demanded for directing, steering or acquiring patients or for any other act that is not a service of the Doctor's own. The Platform saves the reason as a template of the Doctor; only the Doctor sees, changes and deletes their templates.
The claim appears immediately, without release by BGGI, in the portal of the patient, together with a notification. The Doctor is responsible for the reason and the amount; they claim only what they have performed and what has not already been paid. There is no upper limit. Each claim receives its own sequential number; creation, payment, credit and withdrawal are recorded in the audit trail with the time and the acting person.
BGGI adds to the amount, vis-à-vis the patient, a platform share of currently 15 percent; BGGI may set a different rate for each country, the rate shown with the claim being authoritative. The platform share is the fee for BGGI's services in connection with the direct payment, namely processing of the payment, invoicing, receipt and administration. It does not reduce the Doctor's amount, and the Doctor pays BGGI nothing for it. No agency receives anything from it; no agency surcharge is levied on the claim.
The patient pays online via the Platform. After receipt of payment by BGGI, the Doctor is notified, and BGGI credits the amount entered to their credit balance; the platform share remains with BGGI. Receipt, invoice or credit note, payout and currency are governed by the terms of this Agreement on remuneration, invoicing and payout. The payment model (§ 16) does not apply to the direct payment.
The Doctor may themselves withdraw an unpaid claim. After payment, only BGGI's administration may withdraw the claim, in particular if the service was not performed; an amount credited is then reversed and, if already paid out, must be repaid to BGGI. The patient does not receive a dunning notice, but a reminder.
Cash: if BGGI has expressly activated cash payments for the Doctor and has set an amount for this, he may accept an open invoice of one of his own cases in cash in the “Collect cash” area, in the name of BGGI and against the receipt of the platform. He never holds more cash than has been released and than he is owed from open claims against BGGI; the platform does not permit a higher cash payment. The cash is due to BGGI: it is booked as an open amount in favour of BGGI and set off against the next payout to the Doctor; if this is not possible, the Doctor pays the amount over in accordance with BGGI's instructions. If the cash payments for a case together reach the amount set on the platform (currently 5,000 euros), the Doctor accepts cash only once the declaration on the source of funds is available and has been confirmed by BGGI.
§ 16 Payment model
The payment model is agreed separately for each doctor: one side proposes, the other accepts, rejects or makes a counter-proposal. It is agreed only once both sides have consented; only then does it affect invoicing.
The agreed terms — payment method, advance payment and balance payment, time of payment and payment deadline — are set out in the annex “Payment model”, which forms part of this Agreement. This Agreement itself does not state any rates, times or deadlines.
Without an agreed payment model, neither an advance payment rate nor a special payment deadline applies; the due date is then determined by law. A change takes effect only once both sides have consented to the new version; until then, the previous version continues to apply.
§ 17 Cancellation, withdrawal of appointments and no-show
If a service is cancelled, the claim relating to it lapses. Advance payments already made are credited against the next invoice or repaid. Each cancellation is recorded with the reason, time and acting person.
If the Doctor cancels a confirmed appointment, the patient receives back the amount paid or — at their choice — a replacement appointment.
If a patient does not appear, the Doctor reports this via the Platform. A cancellation fee and remuneration staggered according to the time of cancellation are not agreed; claims for services already performed remain unaffected.
If a patient does not appear for a paid video consultation and the amount paid is not refunded under the General Terms and Conditions, the Doctor's fee claim for the appointment kept available remains. If the amount is refunded, it lapses.
If BGGI charges the patient a share for the AI interpreter or for a personal interpreter in the event of a no-show, this does not affect the Doctor's fee.
§ 18 No promotional link and no benefit for patients
The Doctor receives no promotional link, no promotional code and no QR code for attracting patients. The Doctor cannot be an inviting person in the “Customers invite customers” programme — not even via their own patient account — and cannot become an agency, active agent or social media partner of the Platform. The same applies to persons acting for the Doctor's practice. The Platform rejects such a registration if the account or e-mail address is already listed as a doctor, clinic, pharmacy, healthcare professional, care partner, diagnostic and service unit or member of a hospital department.
A promotional link or promotional code that BGGI previously issued to the Doctor no longer has any effect. A registration via such a link is not assigned to the Doctor, and it gives rise to no credit or other benefit either for the Doctor or for the registered person.
BGGI grants the Doctor no benefit whatsoever — neither money nor credit, discounts, benefits in kind or other advantages — for the registration, treatment or choice of a patient, and no such benefit is granted to the Doctor via the Platform by agencies, social media partners or diagnostic and service units either. The Doctor does not demand any such benefit, does not accept a promise of one and does not accept one.
The Doctor's remuneration is exclusively the fee for their medical service under § 15. They are not entitled to any share of surcharges, fees or other income of BGGI or an agency.
If the Doctor learns that they themselves or a person acting for their practice is listed as an inviting person, agency, active agent or social media partner, they notify BGGI of this without undue delay. BGGI then ends participation in the programme concerned; no claim arises from the programme for the period thereafter.
§ 19 Term and termination
The Agreement begins upon digital acceptance and runs for an indefinite period. It may be terminated by either party in text form with a notice period of one month to the end of a month; the right to extraordinary termination for good cause remains unaffected.
Treatments already begun and ongoing are duly completed.
An account is closed only if a reason is given; the reason, time and acting person are recorded. If the account is closed because of misuse, deception or breach of contract, the e-mail address remains blocked for re-registration; in all other cases it is released. Invoices, proofs and logs are retained in accordance with the statutory periods.
Access does not end automatically upon termination, so that ongoing treatments can be completed. After notice of termination has been given, BGGI writes to the doctor three times, at intervals of one month each, and points out the consequences. One month after the third letter, the access is marked as ended in the administration; from then on, no new treatments are allocated. The administration decides separately when the access is finally closed and communicates this. Services already performed are invoiced in accordance with this Agreement.
§ 19a Termination for good cause and transfer of support
In addition to the other terms of this contract, BGGI may terminate the contract for good cause without observing a notice period. The contractual partner within the meaning of this section is the other party to this contract. Good cause exists in particular if (a) the contractual partner submits false or forged documents or provides false information; (b) the contractual partner acts in serious breach of its duties towards patients or towards BGGI; (c) a document required for its activity, in particular the trade registration, the extract from the commercial register or an official licence, is missing or has expired; (d) insolvency proceedings are opened in respect of the assets of the contractual partner or the opening is refused for lack of assets, the contractual partner is deleted from the register or a licence required for its activity ceases to apply.
If a document under paragraph 1 letter c is missing or has expired, BGGI may, at its own discretion, set a grace period of 14 days within which the contractual partner submits the document; there is no obligation to set a grace period. If the contractual partner submits the document within the grace period, termination on this ground is excluded. In the cases of paragraph 1 letters a, b and d, BGGI may terminate immediately and without prior warning.
While BGGI examines whether good cause exists, BGGI may block the access of the contractual partner and its staff to the platform in whole or in part. BGGI notifies the block and its reason in text form and gives the contractual partner the opportunity to comment. If good cause is not confirmed, BGGI lifts the block without undue delay.
If BGGI terminates for good cause or if access is blocked under paragraph 3, BGGI may transfer the support of the patients, the facilities and the ongoing cases that the contractual partner supports to another suitable body selected by BGGI. The contractual partner cooperates in the transfer and hands over the documents and information required for this exclusively via the platform. A treatment passes to another doctor or another facility only with the consent of the patient; the rights of patients to object to a change remain unaffected.
BGGI informs the patients concerned of the transfer and names the body that will support them in future. BGGI does not inform them of the reason for the termination or the block.
Services that the contractual partner has rendered in accordance with the contract up to the termination or up to the block are remunerated in accordance with the rules of this contract. Remuneration and shares for services rendered after the transfer are due to the body to which the support was transferred.
§ 20 Liability and limitation of liability
The medical service — in particular indication, information, consent, examination, treatment, prescription, documentation, brief feedback and aftercare — is owed and answered for solely by the Doctor in their own name. This also applies to the accuracy of their profile information and price quotations and to persons they engage to fulfil their obligations.
BGGI owes the Doctor exclusively the organisation and support services under § 3. BGGI neither owes the medical service itself nor answers for its success, its quality or its lawfulness. BGGI's approvals, checks and notices — for example regarding professional authorisation, profile information, images or feedback — serve the organisation of the Platform; they do not relieve the Doctor of any obligation of their own.
BGGI does not owe uninterrupted availability of the Platform. Commitments by agencies regarding cases, revenue or terms bind BGGI only insofar as BGGI has confirmed them in text form.
The Doctor indemnifies BGGI against claims by third parties — in particular by patients, relatives, payers and authorities — that are based on a breach of duty for which the Doctor is responsible in connection with their medical service or their information on the Platform, including the reasonable costs of legal defence. BGGI informs the Doctor without undue delay of claims asserted, does not acknowledge them without consultation and gives the Doctor the opportunity to participate in the defence. If BGGI contributed to causing the damage, the indemnity is reduced in proportion to BGGI's share of causation.
The Doctor's insurance cover is governed by § 5 paragraph 3.
BGGI is liable without limitation for its own services in the event of intent and gross negligence, injury to life, body or health, under the Product Liability Act (Produkthaftungsgesetz) and to the extent of an expressly assumed guarantee. In the event of simple negligence, BGGI is liable only for the breach of material contractual obligations — obligations whose fulfilment makes the proper performance of this Agreement possible in the first place and on whose observance the Doctor may regularly rely —, limited to the foreseeable damage typical of the contract. Otherwise, BGGI's liability is excluded. These limitations also apply to the personal liability of its bodies, employees and vicarious agents.
This paragraph governs the relationship between BGGI and the Doctor. Mandatory statutory liability and rights to which patients are entitled under mandatory law remain unaffected; § 23 takes precedence.
§ 21 Data protection
The parties comply with the General Data Protection Regulation and the German Federal Data Protection Act (Bundesdatenschutzgesetz). The Doctor is an independent controller for the treatment; BGGI is the controller for the operation of the Platform. Where necessary, the parties conclude supplementary agreements, in particular on processing on behalf.
The Doctor uses personal data of patients supported via the Platform exclusively for treatment and processing via the Platform, not for their own advertising.
If the Doctor takes part in a video consultation with the AI interpreter or with transcription and summary, their contributions are also processed, namely for speech recognition, translation, speech output of the translation and summarisation by the service providers named in the privacy policy: as at the date of this Agreement, ElevenLabs for speech recognition and Anthropic for translation and summarisation, as well as Google Cloud via the endpoint of the European Union for speech output, for Persian ElevenLabs. If the AI interpreter shows an artificially generated face, Beyond Presence generates the image from the finished voice of the translation; the image runs via a separate video server of BGGI in Frankfurt am Main. ElevenLabs, Anthropic and Beyond Presence have their registered offices in the United States; processing by them includes a transfer to countries outside the European Union. Details are set out in the privacy policy.
Feedback, assessments and summaries contain health data. The Doctor uses them exclusively for treatment and processing via the Platform.
If the patient withdraws consent to the processing of their health data, the case is suspended: until consent is given again, the Doctor receives no access to the health data of the case, and the appointments of the case do not appear in their calendar.
If the Doctor is assigned to a hospital, the hospital sees in its calendar the Doctor's appointments for cases that it sees itself, with time, name of the patient, name of the Doctor, case number and status. Video consultations of the Doctor appear there only if the Doctor has switched this on in their profile; without this setting, the hospital does not see them.
Connecting a calendar: the Doctor may connect his own calendar at Google, at Microsoft or at another provider with CalDAV access to the platform, only by his own release, and may disconnect it at any time. The platform enters his appointments there in a separate calendar “Love Your Life
§ 22 Confidentiality
The parties treat trade secrets, terms and conditions and all non-public information of the respective other party that becomes known to them in the context of this Agreement as confidential. This obligation continues after the end of the Agreement.
The Doctor's medical confidentiality remains unaffected. BGGI grants its employees and the service providers engaged access to health data only to the extent necessary for their task and binds them to confidentiality.
§ 23 Professional law reservation
All terms of this Agreement apply only insofar as they are compatible with medical professional law and mandatory law. In particular, the free choice of doctor remains unaffected; no term is to be understood or applied as an allocation of patients against payment within the meaning of § 31 of the Model Professional Code for Doctors Practising in Germany (Musterberufsordnung).
This expressly applies to the brief feedback (§ 8) and to cooperation with diagnostic and service units (§ 12). § 18 ensures that the Doctor receives no benefit for the registration, treatment or choice of a patient. No term of this Agreement obliges the Doctor to direct patients to particular doctors, hospitals, pharmacies, units or other providers.
A visibility package booked by a provider on the Platform has no influence on which doctor a case is allocated to and has no effect on the emergency page or in any other emergency channel of the Platform.
§ 24 Amendments to this agreement
BGGI may amend the text of this Agreement, in particular in order to adapt it to a change in the legal situation or case law, to changed services and processes of the Platform or to changed technical or economic conditions. The amended version is displayed to the Doctor on the Platform before it applies. The amended passages are displayed; the parts not amended continue to apply unchanged.
Consent is given electronically on the platform. The time of consent and a checksum of the version consented to are recorded. Each version remains readable in the account file and can be retrieved there at any time; consent can thus be proven.
In addition, an e-mail about an amendment is sent to the address stored in the account. Irrespective of this, the amendment appears at the next login. The decision can be postponed; the notice then appears again.
Silence does not constitute consent. Without express consent, the amended version does not enter into force vis-à-vis the Doctor; until then, the version last consented to continues to apply.
If consent is not given, BGGI reminds the Doctor. If an amendment is urgent or legally mandatory, attention is additionally drawn clearly to it and to the consequences of consent not being given. The reminders are sent within 30 days of the first display of the amended version. An amendment is urgent if, without it, the secure operation of the Platform, the protection of data or the fulfilment of contractual obligations would be jeopardised; it is legally mandatory if a legal rule, an official or judicial decision or a binding requirement of a payment service, an app store or a supervisory body requires it and BGGI has no discretion of its own in this respect. The notice states the reason, the passage concerned and the consequence of consent not being given. Even an urgent or legally mandatory amendment does not take effect without consent.
If the Doctor does not consent to an amendment, BGGI may terminate this Agreement. The termination is announced in advance and reasons are given; it is possible at the earliest after the expiry of 30 days from the first display of the amended version.
Assignments already placed, appointments already confirmed and ongoing cases are duly completed in accordance with the version last consented to. Claims to remuneration for services already performed remain unaffected; the right to terminate for good cause likewise remains unaffected.
A new signature is only required where the law prescribes a particular form for a declaration; it is then obtained separately. Determinations that this agreement expressly assigns to BGGI are not amendments to the agreement; the conditions stated there apply to them.
§ 25 Formal requirements
Amendments and supplements to this Agreement require text form; this also applies to an amendment of this form requirement. Digital acceptance and electronic consent via the Platform under § 24 satisfy the text form requirement. Notices of termination are given in text form.
Individual agreements between the parties take precedence over this agreement.
§ 26 Applicable law
This Agreement is governed by the law of the Federal Republic of Germany. The professional law applicable to the Doctor at the place of their activity remains unaffected.
§ 27 Place of jurisdiction
If the Doctor is a merchant, a legal entity under public law or a special fund under public law, or if they have no general place of jurisdiction in Germany, the exclusive place of jurisdiction for all disputes arising from this Agreement is BGGI's registered office in Bonn. Otherwise, the statutory places of jurisdiction apply.
§ 28 Severability clause
Should any clause of this agreement be or become invalid or unenforceable in whole or in part, the validity of the remaining clauses shall remain unaffected. The invalid or unenforceable clause shall be replaced by the statutory rule.
§ 29 Language versions
This document is available in 24 languages. Only the German version is binding; the other language versions serve comprehension purposes.
In the event of discrepancies between the German version and a translation, only the German wording applies. Each translation contains this notice in its own language.
